RENTAL POLICY

Below you will find the Rental Policy of Upscale Luxury Car Rental, Inc.(hereinafter referred to as “Upscale Luxury Car Rental”, “Upscale Cars” and or “We”).  These terms and conditions, the rental record signed by you and any other documents which you are required to sign when you rent the car, together constitute the Agreement( "This Agreement") for the Rental of the Vehicles identified on the rental record, including all of its parts ("CAR"). This Agreement is between You and Upscale Luxury Car Rentals which is identified as ("Upscale Cars").Please note that this policy is subject to change without notice, at the discretion of Upscale Cars.

Rental Requirements

All clients of Upscale Luxury Car Rental must complete a rental application prior to receiving a vehicle. 

You must have in your physical possession a valid driver’s license and a major credit cardor debit card  at the time of the rental. Please bring proof of insurance with you when you pick up the rental car.

Insurance Coverage

Due to the types of vehicles we rent and the nature of the insurance industry, all renters must carry their own liability and physical damage policies 

All renter's must have full coverage (comp. and collision) on their current car insurance policy to rent from us.  If a renter does not have their own coverage, we offer several other options to provide coverage during a rental. Please inquire for details on these options.

Orientation

We require that all first time renters to go through a short 10-15 minute orientation on the vehicle that they will be renting. This is done so that you will be familiar on how to operate the car in a safe and efficient manner.

Additional Drivers

All additional drivers must be at least 21 years of age with a valid driver’s license.  If drivers other than the primary renter will be operating the vehicle, they must be listed as additional drivers on the rental agreement . Additional driver fee will apply. The additional driver must have in your physical possession a valid driver’s license and a major credit card and full coverage insurance in the same name at the time of the rental. Additional driver must be present at the time of the rental and must meet all of the qualifications as the primary renter.

Rental Rates

We have daily, weekly  and monthly rentals.

Reservations 


To make a reservation we will need to run a credit card authorization and verify which form of insurance will be used. You can supply all necessary information over the phone at 713 409 5508 or through our online reservations contact form . After making a reservation on the Web, you will be contacted by phone for confirmation. To guarantee that you will have the car you want, we highly recommend making a reservation as soon as you know when you will need the car. We do not charge your credit card for the rental until you pick up the vehicle.  

Reservation Deposit

A deposit is required for security purposes for any potential minor damages like no-shows or for cancellations. The amount of the requested deposit will be returned to you.The deposits is based on the type of vehicle, usually from $250.00 to $500.00 for cash deposits.

Payment Methods

Upscale Luxury Car Rental accepts the following methods of payment: Cash, Traveler's Checks, Money Order, Company Account , VISA, Master Card, AMEX, Discover. Cash deposits are  accepted

Professional Chauffeur

For those of you that would like to sit back and enjoy the sights, we offer professional drivers at an additional cost. A minimum of four hours will apply. 

2nd/3rd Choice Vehicles

Although, we will try our very best to provide you with the vehicle of your choice. We ask for you to choose  alternative vehicles in the event your first/second choices becomes unavailable. Unfortunately, we have no control over vehicles not being returned by customers on time or if the vehicle is returned with physical or mechanical damage. 

Damage Deposit Requirements

All renters must leave a damage deposit in the form of cash, a credit card  or  cashier's check. Any damage found on the vehicle upon return will be billed against this deposit. The amount of this deposit will vary depending on the vehicle and the number of days vehicle is being rented.

Age Requirements 


All renters must be at least 21 years old. For some of our higher end cars you will need to be at least 25 years old. You will need a credit card, which is used as your deposit. You will need to show us a valid driver's license with photograph and proof of insurance when you come to pick up your car. Some cars have a surcharge for renters under 25 years old. A underage fee ranging from US$ 39.99 to 59.99 will apply.

Pick-Up & Delivery Service

Pick-Up and Delivery may be available within a 5 mile radius of our office. Minimum rental applies, so please contact the rental office for availability and restrictions. 

Drop-Offs

Our chauffeurs could drop you off at various airports around Houston . Please ask your rental agent about the availability and rates. Free pick up and drop off is included when a premium vehicle (one that costs $700 and up per day) is rented .  A minimal charge will apply if total rental fee is less than $700.00 a day.

Return Times

All vehicles must be returned by 11.00 am on Return Dates or additional charges will apply. This applies to vehicles rented after 11.00 am.

Music Video/Film/Production Use

Additional photos are available of all our vehicles upon request.

Driving Area/Geographic Restrictions

Vehicles rented from Upscale Luxury Car Rental must stay within the  Texas borders. Special arrangements may be made by calling office as to other destinations. All permissions must be done in writing. Please note that any vehicle traveling outside the authorized area is subject to a surcharge and may be in violation of the rental agreement.

Prohibited Uses 


The vehicles may not be used:

• To carry people or property for hire
• To operate any vehicle under the influence of any drugs or alcohol
• On any unpaved surface
• For any illegal purpose or in connection with any illegal activity
• By anyone not licensed to drive or who's Driver's License has been suspended or restricted
• To push or tow anything
• To exceed any posted speed limits
• In any speed test, speed contest, race, rally, demonstration, or near any racetrack or road course. (this is something we really enforce because there is no insurance company that will cover the car while on the track, and that means the renter will be liable completely for any losses incurred)
• To teach anyone to drive

In the event of a violation of these Prohibited Uses, we reserve the right to remotely disable the vehicle.

Drivers License Record 


You must have a valid driver's license to rent. We run DMV reports on every renter. You may not have had your license revoked, had a DUI, DWI, suspension or any other criminal conviction within the last 3 years. We reserve the right to cancel rental for clients with previous driving records.

No Towing 


Nothing is allowed to be connected to our vehicles at any time.

Cancellation Policy

When you make a reservation, we may authorize your credit card immediately for up to the full cost of the rental, though you will not be charged until you physically take possession of the vehicle.
Because we have a limited supply of vehicles to offer, we pack the schedule very tightly. We offer a 24-hour grace period after you make your reservation to make changes or cancel (unless the rental is within 7 days), after which there will be a cancellation fee of 50% of the total rental cost or $500 (whichever is greater).
If you cancel or reschedule less than 7 days before your rental (or are a no-show at the time of rental), you will be charged a cancellation fee of 100% of the total rental cost.Please understand that there are no exceptions to this cancellation policy. 

Refunds

We do not offer refunds for vehicle rentals or gift certificates. However, our goal is total satisfaction for our renters, so in certain situations we may offer credit for additional rental days. This is solely at our discretion.
In the event of an unforseen mechanical failure during or prior to a rental, we will make every effort to repair or replace your vehicle with a similar or better model at no additional cost to you.

Fees

An 11.11% Concession Recovery Fee will be applied to all rentals. Vehicle License Fee reimbursement 2.25 per day. A 3% Credit Card Charge Fee of Total Rental is applied to rental  if credit card or debit card is used for the rental.

Tickets

The renter is responsible for all parking , traffic, speeding or other tickets or violations issues while the vehicle is being rented  and must pay for any fees, penalties, towing charges and impound costs.

Discounts

Discounts and special incentives cannot be combined or 'stacked' unless explicitly indicated. So if you get a 10% early-booking discount, that cannot be combined with a seasonal discount as well.

Contract Dates / Extensions

You may be asked to return to the Upscale Luxury Car Rental office in order to extend any rental agreement. Contracted rates may change once your original return date has passed so please contact your rental office for details.

Grace Period

Upscale Luxury Car Rental allows for a  one hour grace period after your scheduled return time. Surcharges and full daily rates apply after the grace period has expired. Please refer to your rental agreement or call the rental office for details. NO grace period is allowed for unauthorized extension of contracts. 

Past Due Amounts

Past due amounts will accrue the lesser of either $5.00 per day or the maximum amount allowed by law. Customer agrees to pay all reasonable costs and fees (including attorney fees) incurred by Upscale Luxury Car Rentals in collecting any amounts due. 

Child Seats / Boosters

Child and Booster seats are available for your rental needs. Availability may be limited so please make reservations in advance. Daily rates do apply so please ask your reservations specialist at the time of reservation for rate details.

Driving Rules & Regulations in Texas

Texas has an open container law. It is illegal to have opened alcoholic beverages in the driver or passenger areas of a vehicle while it is being driven. You cannot refuse to take a breath, blood or urine test as directed by a police officer. Blood samples can be drawn involuntarily, even on a first offense.  In Houston area, parking meters and painted curbs are in operation and are closely monitored 24 hours a day by the authorities. Citations and fines are expensive; to avoid them, be sure to read all parking signs carefully before parking your vehicle.

International Drivers

International drivers are welcome! We accept foreign drivers license for many countries, and of course all international licenses are accepted. Drivers with foreign licenses must present your passport along with your driver's license.If you are living in the USA whether permanently or temporarily, you must also bring with you proof of where you reside. This might be a telephone bill or a pay stub. We must be able to identify your place of residence while in the USA. These requirements are due to Homeland Security issues. If you are staying with family or friends while in the USA , you must supply us with their address and valid telephone number. Thank you for your cooperation.Vehicles are available to international visitors with a valid passport and driver's license from their home country. We can provide insurance coverage for those international visitors renting for a minimum of seven days.

Non-Smoking Policy

Upscale Luxury Car Rental encourages a smoke free environment when inside of any of our meticulously detailed vehicles. A Fumigation and cleaning charge will apply if this policy is violated.

MileageDaily and weekend rentals include 100 miles free per day and weekly rentals include 700 miles free, unless stated otherwise. Each additional  mileage driven will be subject to a charge at the stated mileage rate. Vehicles driven over the mileage allowed per day will be subject to an additional surcharge  (depending on the vehicle)  in order to cover excess wear and tear.

Damaged Tires & Rims

The renter is fully responsible for all tire, wheel, and hubcap damage during the rental. Whether the tire and wheel were damaged by road hazard, driver error, or even a blowout, the renter will be held responsible and charged for any expenses to repair the vehicle or replace the tire or related components. If towing is necessary, the renter is also responsible for all towing expenses.

Vehicle Breakdown

It is unlikely since most of our vehicles are late models and stringently maintained. However, if a breakdown does occur, immediately call the phone number on your rental contract, and we will take care of it. Do not repair our vehicle.

Refuel Charges

Vehicles must be brought back with the same amount or more  of fuel as we initially provided. If not, re-fueling charges will apply. Fees vary depending on pump prices. If you return it with less gasoline, we will charge you $6.49/gal used. (Rate is subject to change based on current gas prices). The fuel level amount will be printed on your rental contract. . However, when you do gas up, all vehicles must be refueled with Premium grade (93+ octanes) gasoline. There is a $250 fee for filling up with a lesser grade. And yes, we'll know.Local Airport Drop Available

SHUTTLE INFORMATION

Customers may leave their rental cars at pre-approved Parking Cents airport locations for an additional flat fee. Please call Upscale Luxury Car Rental for complete details. Return rental cars to Parking Cents Parking lot. Parking Cents offers a courtesy airport shuttle to and from all Airport terminals .  

Upscale Luxury  Car Rentals accepts no responsibility or liability for errors, omissions, damages, injuries, liabilities, or losses of any client or affiliate.
