RENTAL/LEASE CAR SERVICE POLICY
Below you will find the Rental Policy of Upscale Luxury Car Rentals. These terms and conditions, the rental record you sign and any other documents which you are required to sign when you rent the Vehicle, together, constitute the Agreement (the “Agreement”) for the rental of the Vehicle(s) identified on the rental record, including all of its parts (the “Vehicle”). This
Agreement is between ___________ _____________________(hereinafter referred to as “Client(s),” “Primary Client(s)” and or “You”) and Upscale Luxury Car Rentals (hereinafter referred to as “Upscale Cars” and or “We”). Please note that this policy is subject to change without notice at the discretion of Upscale Cars.
Description of Rented Vehicle You are renting from us, and received , the following vehicle and/or Chauffeur:

Rental Requirements All Clients must complete a rental application prior to the Pickup Date.You must have in your physical possession a valid driver’s license and a major credit card or debit card at the time of the rental. Please bring proof of insurance with you to pick up the Vehicle.
Orientation We require that all first time Clients to go through a short 10-15 minute orientation on the Vehicle. This is done so that you will be familiar with how to operate the Vehicle in a safe and efficient manner.
Rental Rates: We have daily, weekly and monthly rentals. The lease contract herewith is a _______ minimum. You agree to keep vehicle for the entire duration of the rental/lease contract(1)You agree to pay charges at the rates and in the amount that appear on the rental agreement. (2)You will rent and return the vehicle at the times and places indicated on rental agreement. (3) If mileage charge applies, You will drive no more than the distance indicated and (4) If you incur any charges that are either not listed on Rental Agreement… or cannot be calculated until return, then additional charges will apply. The charges on the initial Rental Agreement are not final until you return the vehicle. You agree that signature on the initial Rental Agreement covers the final Rental agreement even if there is no signature.
Reservations: To make a reservation we will need to run a credit card authorization and verify which form of insurance will be used. You can supply all necessary information over the phone at (713) 409 5508 or through our online reservations contact form. After making an online reservation, you will be contacted by phone for confirmation. To guarantee that you will have the Vehicle you want, we highly recommend that you make the reservation as soon as you know when you will need the Vehicle. We do not charge your credit card for the rental until you pick up the Vehicle.
Reservation Deposit: A deposit based on the type of Vehicle, usually from $300.00 to $3,000.00, is required to cover any outstanding charges, fees and costs. With the exception of any such charges, fees and costs, the deposit is fully refundable.
Payment Methods: Upscale Cars accepts the following methods of payment: Cash, Traveler's Checks, Money Order, Company Account, VISA, Master Card, AMEX. Cash deposits are also accepted.
Professional Chauffeur: For those Clients that like to sit back and enjoy the sights, we offer professional drivers at an additional cost. A four hour minimum is required for service.
Additional Authorized Drivers and Fees Drivers other than the Primary Client must meet the same qualifications as the Primary Client, be present at the time of the rental and be listed as additional drivers on the Agreement. An additional driver fee will apply. The Primary Client and Additional drivers agree to be held jointly and severally liable for any loss, damage, costs or charges incurred under the Agreement. No additional Authorized Operators should drive the vehicle without our prior written approval. Your spouse may be added as an Authorized Operator of the Car by signing as the Additional Authorized operator at the time of rental. An additional operator fee will charged
Authorized Drivers: The UPSCALE LUXURY CAR RENTALS vehicle may be driven only by an authorized driver. An authorized driver is the renter and any additional person who appears at the time of rental and signs the rental agreement. All authorized drivers must satisfy our age requirements, have a valid drivers license, and fulfill our other qualifications, which vary by location The authorized driver and any additional authorized drivers may be subject to a driver record check (See below). No other persons are authorized to drive the vehicle.
Additional Authorized Drivers and Fees: All additional authorized drivers are required to qualify to drive the vehicle. To qualify, Upscale Luxury Car Rentals requires all additional drivers, including spouses, to satisfy our minimum age requirements, have a valid drivers license and pay an additional driver fee. However, the following additional drivers do need to pay an additional driver fee or separately qualify as long as they meet our minimum age requirements and have a valid drivers license: (1) government renters on official orders, (2) corporate account customers on corporate rate plans, and (3) drivers/companions of physically impaired customers. The additional driver may also be subject to a driver record check and an underage drivers fee. (See below). Because the requirements vary by location, please refer to the Local Policies for specific information on additional driver fees charged at the location where you intend to rent.
Underage Driver's Fee: An authorized driver 18 to 24 years of age may be charged an Underage Drivers fee because of such driver's age in addition to the additional driver fee, if applicable. Because the requirements vary by Upscale Luxury Car Rentals location, please refer to the Local Policies for specific information on additional authorized or underage drivers at the location where you intend to rent a Upscale Luxury Car Rentals vehicle.
2nd/3rd Choice Vehicles: Although we try our very best to provide you with the Vehicle of your choice, we ask you to choose alternative vehicles in the event your first or second choice becomes unavailable. Unfortunately, we have no control over vehicles not being returned by customers on time or if the Vehicle is returned with physical or mechanical damage.
Damage Deposit Requirements: All Clients must leave a damage deposit in the form of cash, a credit card or cashier's check. Any damage found on the Vehicle upon return will be billed against the deposit. The amount of the deposit will vary depending on the Vehicle and the number of days the Vehicle is being rented.
Age Requirements: All Clients must be at least 21 years old. For some of our higher end vehicles you will need to be at least 25 years old. Some vehicles have a surcharge for Clients less than 25 years old. In that event, an underage fee of $_____ each day will apply.
Pick-Up & Delivery Service: Pick-Up and Delivery may be available. A minimum rental applies, so please contact the rental office for availability and restrictions.
Drop Charges: A drop charge, also referred to as an "inter-city fee,” may apply for renting the Vehicle in one rental location and returning the Vehicle to a different rental location
Return Times: All vehicles must be returned on or before 11.00 am on the Return Date. Additional charges will apply for vehicles returned after 11:00 am on the Return Date. This return restriction also applies to vehicles rented after 11.00 am.
Music Video/Film/Production Use: Additional photos are available of all vehicles upon request.
Driving Area/Geographic Restrictions: Vehicles rented from Upscale Cars must stay within the Texas borders. Special arrangements are available if made in advance. All permissions must be in writing. Any Vehicle traveling outside the authorized area is subject to a surcharge and may be in violation of the Agreement.
Prohibited Uses The Vehicles may not be used:
In the event of a violation of the Agreement, we reserve the right to remotely disable the Vehicle.
Unauthorized Uses & LDW Exclusions
Each Renter shall be fully responsible for all loss or damage to the Vehicle, regardless of fault or cause.
The acts and/or uses listed below are prohibited and violate the scope of permissive use of the Vehicle. If Loss Damage Waiver (LDW) protection has been purchased, any of the following acts, uses or operations of the Vehicle will void LDW coverage:
Drivers License Record: You must have a valid driver's license to rent. We run DMV reports on every Client. You may not have had your license revoked, had a DUI, DWI, suspension or any other criminal conviction within the last 3 years. We reserve the right to cancel the rental for Clients with negative driving records at any time.
No Towing: Nothing is allowed to be connected to the Vehicle at any time.
Cancellation Policy: Because our vehicles are in high demand and supply is limited, the schedule is packed very tightly. Note that when you make a reservation, we may authorize your credit card immediately for up to the full cost of the rental Also, note the following: There are no cancellations allowed 24 hours after booking the reservation.
There are no cancellations allowed within 84 hours of the Pick-up Date.
There are no cancellations allowed on any rental/lease term greater than 30 days.
Please understand that there are no exceptions to the cancellation policy. You are obligated to pay for the entire lease term if you cancel your reservation in any of the above circumstances.
If your reservation is canceled in advance, no cancellation fee will be assessed. Reservations may be cancelled by calling (713) 409 5508. You will be issued a cancellation number
A non-cancellation fee applies to a reservation that is either not timely cancelled prior to the reserved Pickup Date or if the Client fails to pick the vehicle up. The fee may vary by location and vehicle group up to one day's rental fee plus taxes and surcharges. The fee is provided during the reservation process prior to confirmation. The reservation must be timely cancelled in order to avoid the fee.
Chauffeur Services Cancellation Policy You must give seven days advance notice in order to cancel the Chauffeur Services. This notice must be in writing to rental@upscalecarrentals.com. You are obligated to pay the lesser of the entire Chauffeur Services term if you cancel your reservation or a minimum of seven days chauffeur rental fees multiplied by the hourly rate. Please understand that there are no exceptions to the cancellation policy. By signing the credit card authorization form, you under that your credit card on file will be charged for early cancellations or termination.
Refunds: Our goal is total satisfaction. Therefore, there is no refund for Vehicle rentals or gift certificates. However, in certain situations, at our sole discretion, we may offer credit for rental days.In the event of a highly unlikely mechanical failure during or prior to a rental, we will make every effort to repair or replace your Vehicle with a similar or upgraded model at no cost to you.
Fees: Vehicle License Fee reimbursement is $2.25 per day. An 11.11% Concession Recovery Fee will be applied to all rentals. Our standard gratuity is 20% cost of car hire (only chauffeur driven cars). This amount will be added to the cost of car hire (only chauffeur driven cars). Taxes will be applied at applicable rate based on jurisdiction – 15% inTexas. A 5% Credit Card Charge Fee of Total Rental is applied to the rental if a credit or debit card is used for rental.
Tickets: The Client is responsible for all tolls, parking, traffic, speeding and or other tickets or violations, including any fees, penalties, impound and towing charges and other costs incurred during the rental period.
Discounts: Discounts and special incentives cannot be combined or 'stacked' unless explicitly indicated. For example, if you get a 10% early-booking discount, that discount cannot be combined with a seasonal discount as well.
Contract Dates / Extensions: You may be asked to return to the Upscale Cars office in order to extend any rental agreement. Contracted rates may change once your original return date has passed, so please contact your rental office for details.
Grace Period: Upscale Cars may allow a one hour grace period after your scheduled return time if approved in advance. Surcharges and full daily rates apply after the grace period has expired. Please refer to your rental agreement or call the rental office for details. NO grace period will be allowed after an unauthorized extension of a rental contract.
Past Due Amounts: Past due amounts accrue daily up to the maximum rate allowed by law. Nonpayment of past due amounts can result in a judgment against you and a lien against your property. The Client agrees to pay all reasonable costs and fees, including attorney fees, incurred by Upscale Cars in collecting any past due amount.

Child Seats / Boosters: Child and Booster seats are available for your rental needs. Availability may be limited so please make reservations in advance. Daily rates do apply so please ask your reservations specialist at the time of reservation for rate details.
Driving Rules & Regulations in Texas: Texas has an open container law. It is illegal to have opened alcoholic beverages in the driver or passenger areas of a Vehicle while it is being driven. You cannot refuse to take a breath, blood or urine test as directed by a police officer. Blood samples can be drawn involuntarily, even on a first offense.
InHoustonarea, parking meters and painted curbs are in operation and are closely monitored 24 hours a day by the authorities. Citations and fines are expensive; to avoid them, be sure to read all parking signs carefully before parking your Vehicle.
International Drivers: International Clients are welcome! Vehicles are available to international Clients with a valid passport and driver's license from their home country. All international licenses are accepted. Insurance coverage is available for international Clients renting for a minimum of seven days. Whether you are living in theU.S. permanently or temporarily, you must also bring with you proof of where you reside such as a telephone bill or a pay stub. We must be able to identify your place of residence while in theU.S. These requirements are due to Homeland Security issues. If you are staying with family or friends while in theU.S., you must supply us with their address and valid telephone number.
Smoke-Free Policy: Upscale Cars is proud to offer you a smoke-free environment inside of our meticulously detailed vehicles. Fumigation and cleaning charges apply if this policy is violated.
Mileage: Daily and weekend rentals include 50-100 miles free per day and weekly rentals include 250-500 miles free, unless stated otherwise. Each additional mileage driven will be subject to a charge at the stated mileage rate. Vehicles driven over the mileage allowed per day will be subject to an additional surcharge (depending on the Vehicle) in order to cover excess wear and tear. The excess mile charge is Vehicle is $1.29 - $4 per mile.
Damaged Tires & Rims: The Client is fully responsible for all tire, wheel, and hubcap damage during the rental. Whether the tire and wheel were damaged by road hazard, driver error, or even a blowout, the Client will be held responsible and charged for any expenses to repair the Vehicle or replace the tire or related components. If the Vehicle is towed, the Client is responsible for all towing expenses.
Mechanical Breakdown: It is unlikely since most of our vehicles are late models and stringently maintained. However, if a breakdown does occur, immediately call the phone number on your rental contract, and we will take care of it. Do not repair our Vehicle. In the event of a mechanical breakdown or malfunction, Renter will cease operation of the Vehicle at the first sign of mechanical trouble. In such an event, Renter will contact UPSCALE LUXURY CAR RENTALS immediately. Renter will not authorize or attempt any repair(s) to the Vehicle without Upscale Luxury Car Rentals prior written approval. Renter is fully responsible for any unauthorized repair(s) and any damage caused thereby.
Any service to, or replacement of, a part or accessory on the Vehicle must have Upscale Luxury Car Rentals prior written approval.
If Renter smells oil, gasoline, or any kind of burning, Renter shall in a safe manner immediately stop the Vehicle and immediately call UPSCALE LUXURY CAR RENTALS for roadside service. UPSCALE LUXURY CAR RENTALS will come out and inspect the Vehicle and make arrangement for a replacement vehicle, if appropriate. In case of fire, please call the fire department first.
Vehicle Maintenance: You are responsible for all maintenance, repair, service, and operating expenses of the Vehicle. You agree to follow owner’s manual and maintenance schedule, and provide us with written proof of such maintenance. You are responsible for all damage to the Vehicle and its loss, seizure or theft.
Insurance Coverage Due to the types of vehicles we rent and the nature of the insurance industry, all Clients must carry their own liability and physical damage policies.
All Clients must have full coverage (comprehensive and collision) on their current car insurance policy to rent from us. If a Client does not have their own coverage, or does not show prove of insurance at inception of rental, we will charge Loss Damage Waiver to cover only the car. Return, Repossession and Costs
The Vehicle is the property of Upscale Luxury Car Rentals. Renter agrees to return the Vehicle, together with all tires and equipment:
Upscale Luxury Car Rentals may peacefully repossess the vehicle without demand or notice at any time if:
The Renter is not Upscale Luxury Car Rentals agent for any purpose.Renter is responsible for all reasonable costs arising from the Vehicle being (a) returned or left at any location other that the original renting location, or (b) seized by a governmental authority, if such seizure arises from the Renter’s conduct. These costs include parking charges, parking citations, towing, storage and impound fees. If the Vehicle is beyond 10 miles of the renting location, the Renter is responsible for the cost of transporting the Vehicle to the renting location, including the costs of a driver, lodging, and meals. Renter is liable for all attorneys’ fees incurred in recovering the Vehicle, including from a governmental authority. Renter is liable for all parking or traffic violation fines incurred during the rental period, and authorizes Upscale Luxury Car Rentals to charge Renter’s credit card for such fines as well as a $100 administration fee for each.
Loss or Damage to the UPSCALE Vehicle: The renter and any additional drivers are absolutely liable for any loss or damage to the rental vehicle, even if someone else caused it or the cause is unknown, whether due to theft, fire, hail, flood, collision, vandalism, or any other cause, subject to limitations imposed by the law where the vehicle is rented. This liability will not exceed the full value of the vehicle, plus:
Any out-of-pocket expenses incurred by us as a result of the loss or damage to the vehicle; A reasonable administrative fee; and Pro-rata license plate fees, all as allowed by law.All rental charges through the date you report the incident if not returnable or the return date, whichever is later.
B. Third Party Liability Claims: Unless otherwise required by applicable law, a renter and/or any additional authorized driver (and the respective insurance company of each) is primarily responsible for all third party claims of personal injury, including death, and property damage caused or arising from the use and operation of the UPSCALE vehicle during the rental. (To the extent UPSCALE is required to provide coverage, in spite of the terms of the rental agreement, it shall only be in an amount necessary to satisfy the minimum financial responsibility limits required by applicable law.)
Protecting the Vehicle. To protect the Vehicle from vandalism and theft, Renter agrees that Renter:
Property Left in the Rental Vehicle
UPSCALE LUXURY CAR RENTALS is not liable for loss or damage to any property left, stored or transported by Renter, whether or not said loss or damage was caused by or related to negligence of UPSCALE LUXURY CAR RENTALS or Vehicle malfunction. Renter assumes all risk of such loss or damage and waives all claims against UPSCALE LUXURY CAR RENTALS arising from such losses.
Indemnification from Third Party Claims/Lawsuits
Renter agrees that Renter and Renter’s insurer shall defend and indemnify UPSCALE LUXURY CAR RENTALS in connection with any and all injuries, damages, claims, lawsuits, attorneys’ fees, costs and expenses arising out of, or related to, the use and/or operation of the Vehicle.
Renter must immediately report to the police all accidents involving any bodily injury or property damage of more than $100.
In the event of an accident causing any damage or bodily injury, Renter shall notify UPSCALE LUXURY CAR RENTALS immediately, fill out Upscale Luxury Car Rentals Accident Report and set forth in writing a detailed explanation of how the accident happened and identify all witnesses. If this cannot be done in person, Renter will do so by phone or mail within 24 hours of the accident.
UPSCALE LUXURY CAR RENTALS shall not be liable in whole or in part for any indirect, special or consequential damages, including without limitation, loss of time, income, lodging, personal expenses, loss of benefits, suffered or incurred by Renter or any third person relating to or arising out of the furnishing, performance, or use of the Vehicle, including mechanical breakdown or failure to honor a reservation.
UPSCALE LUXURY CAR RENTALS does not indemnify or insure against any claim for bodily injury or property damage caused to third party. Renter is primarily liable for such claims under Texas law.
Neither Renter’s Liability Protection (RLP), nor Supplemental Liability Insurance (SLI), if purchased, insures Renter for property damage or loss caused to the Vehicle. Renter remains fully responsible for all damage and loss to the Vehicle, unless Loss Damage Waiver (LDW) applies.
Renter covenants and agrees Renter will hold harmless and indemnify UPSCALE LUXURY CAR RENTALS, the Vehicle owner, lessor, and lien holder from any and all claims, demands, causes of action, attorney fees, costs or expenses of any kind that relate to, or arise from, any alleged negligent use or operation of the Vehicle during the terms of the rental.
Notice About Your Financial Responsibility & Optional Damage Waiver
Renter is responsible for all damage or loss to the Vehicle, even if caused by someone else or the cause is unknown. Renter is responsible for the cost of repairs (up to its full value), loss of use, diminished value, towing, storage and impound fees.
The Renter’s insurance, or the credit card used to pay for the rental transaction, may cover all or part of Renter’s financial responsibility for the Vehicle. Renter should check with the Renter’s insurance company, or credit card issuer, to find out about the coverage and the applicable deductible, if any, for which Renter may be liable.
If a credit card was used that provides coverage for potential liability, Renter should check with the card issuer to determine if the Renter’s personal insurance coverage limits much first be exhausted before the credit card coverage applies.
UPSCALE LUXURY CAR RENTALS will not hold you responsible for damage, repair costs, or loss of use of the Vehicle if Loss Damage Waiver (LDW) is purchased. CAUTION: Loss Damage Waiver (LDW) will be voided in the event any of the violations specified in Unauthorized Uses & LDW Exclusions and Prohibited Uses. Loss Damage Waiver (LDW) does not protect from liability due to theft or vandalism.
Refuel Charges: You have options. You can save yourself time by purchasing a tank of gas directly from Upscale Cars at the time of rental for $110, and avoid the hassle of searching for a gas station to fill the tank before returning the Vehicle. No refund will be given for unused gas.
Or, the Vehicle must be brought back with the same amount or more of fuel as we initially provided. If not, a flat rate $140.00 re-fueling charge will apply. The fuel level amount will be printed on your rental contract.
All vehicles must be refueled with Premium grade (93+ octanes) gasoline. There is a $250 fee for filling up with a lesser grade. And yes, we will know.
Shuttle Information: Customers may return the vehicles at pre-approved Parking Cents airport locations for an additional flat fee after written permission from Upscale Luxury Car Rental. Parking Cents offers a courtesy airport shuttle to and from all Airport terminals. Please call Upscale Cars for complete details.
Warranty: You are renting or leasing this Vehicle “As Is.” There are no warranties as to the Vehicle’s condition, merchantability, suitability, or fitness for a particular purpose.
Upscale Cars accepts no responsibility or liability for errors, omissions, damages, injuries, liabilities, or losses of any Client or affiliate. Vehicle model and color may vary at time of rental.
By accepting the Car, You acknowledge that You have read and understand, accept and agree to the above Rental Terms and all payments on the Agreement and you accept services as shown on the Rental Agreement.
